1.General These terms of sale and delivery apply to trade between MTR-Cosmetics (hereinafter referred to as the seller) and their customers (hereinafter referred to as the buyer). Both parties undertake to comply with the terms and conditions applicable at the point of order. The customer’s basic details are registered in the seller’s customer register.

 2.Seller’s obligations Terms of delivery All orders over €100 incl. VAT is delivered free of charge. Other orders are charged a one-time shipping fee of €4.75. Unless otherwise agreed in writing, the seller delivers the products to the buyer using the seller’s shipping organization. Reorders of less than €30 incl. VAT must be reordered.

3.Warranty The product sold is guaranteed according to the manufacturer’s terms and conditions unless otherwise stated in the agreement. The warranty period may vary between products used professionally or by consumers.

 4. Product characteristics By receiving the product from the seller, the buyer agrees that the commissioning and use of the product may require special knowledge or care.

5. Liability for defects and product liability The seller is only responsible for design, raw material or manufacturing defects in the product, which corresponds to its sales price. The seller is not responsible for defects in the product, which are due to or caused by inadequate installation or maintenance of the product.

6. Indirect damage The seller is not obliged to compensate the buyer for indirect damage such as loss of production, loss of profit or other financial consequences due to delays or errors in delivery.

7. Buyer’s obligations Prices Unless otherwise agreed in writing, all prices stated by the seller are valid until further notice. All prices include VAT. The seller reserves the right to change the prices stated, if the change is caused by circumstances beyond the seller’s control.

8.Payment period Unless the parties have agreed otherwise in writing, the payment term is the payment term upon purchase. In the event of a written agreement with a company, credit may be granted. The payment period is calculated from the invoice date. If the purchase price is not paid within the specified time, the seller has the right to withhold further deliveries until the overdue payments have been made. The products that have been delivered by the Hairdressing Wholesaler to the customer are considered to be in the Hairdressing Wholesaler’s possession until full payment has been made. MTR-Cosmetics is therefore entitled to repossess these, for example, if hair care machines are not paid in full.

9.Delay in payment In the event of a delay in payment, compensation will be charged for the delay period according to the Swedish Interest Act, calculated from the invoice due date. In addition to interest on late payment according to the applicable interest act, a handling fee for payment reminders is charged and for debt collection, collection costs are charged according to the collector’s current price list. The buyer is not entitled to claim compensation for such delay.

 10. Complaints and remedying defects The buyer is obliged to examine the condition of the product and that the correct product has been delivered. All complaints related to the product must be presented to the seller immediately after the defect or fault has come to the buyer’s attention. The delivery is considered accepted if no complaints have been made within ten days of the delivery date. The seller has the right to first remedy the fault or make a replacement delivery. The buyer must return the faulty product in the original packaging and in salable condition according to the seller’s instructions. The seller examines the returned product to determine any fault itself or has the product manufacturer examine the fault.

11. Right of return and exchange Since we only sell to companies, the right of return and cancellation does not apply. However, we reserve the right to allow the customer to return/cancel their purchase in individual cases. The returned product must then be delivered undamaged in its original packaging and contain all parts. The buyer is always responsible for the return costs. If the sales packaging of the returned product is not in a salable condition, the buyer will be charged according to the current price list. In the case of unclaimed shipments, we will charge the customer the actual shipping costs.

12.Cancellation of the contract The buyer’s right to cancel the contract If the seller’s delivery deviates significantly from the agreement and if the defect is not remedied within a reasonable time despite the buyer’s written notice, or if new contractual goods are not delivered, or if the delivery is delayed for reasons that depend on the seller so that the buyer suffers unreasonable damage, the buyer has the right to cancel the contract. The seller’s right to cancel the contract If the purchase price is not paid within the specified time and this is not due to the seller, the seller has the right to cancel the purchase. If the purchase is canceled in this way, the seller has the right to collect products that have already been delivered at the buyer’s expense. Force majeure The seller is not obliged to fulfill the contract if the delivery is completely or partially prevented by natural disaster, fire, machine failure or comparable disruption, strike, lockout, war, mobilization, export or import ban, transport obstacles, closure of production, traffic disruption
